TERMS OF SERVICE
If you have a problem with any of these terms, they may be changed if discussed with me prior to paying for your commissioned piece.
GENERAL TERMS
- All commissions are digital works only. No prints are currently available for the client.- I have the right to reject any order that I do not feel comfortable drawing for any reason.- Prices are subject to change based on demand.- Non-emote commissions will contain subtle signatures that may not be removed.
PAYMENT
- I accept payments through: Paypal, GCash, Ko-Fi, VGen (Stripe and Paypal).- If payment is given via GCash, it must be sent through express send and not “send with a clip”. Payment with “send with a clip” will not be credited.- If payment is given via VGen, please take note that VGen takes 5% of the fees hence the final price I will be sending will take that 5% fee into consideration. The price you see in my profile is the base price of my services excluding the 5% fee. (I am willing to explain this part in chat if it's hard to understand.) Please also note that Stripe takes their own fees separate from VGen so this will also be included in the final computation sent to you.- The client will shoulder all other fees of their chosen mode of payment. I, the artist, must receive the entire amount of the commission price quoted to you.- I require at least 50% down payment in order to start a commission and to send sketches.- The rest of the 50% may be sent anytime before the delivery of the final artwork/s. Should the client prefer to pay 100% upfront, this will also be accepted.- Complex artwork requiring a lot of detail is subject to additional fees from the base price depending on the complexity.- RUSH COMMISSIONS: Commissions which have a deadline within 3 days of ordering will be subject to a priority fee of 50% of the total commission cost.- Commercial use: Entails additional charges depending on intended usage. Minimum of 75% of the total commission cost and may be even higher.
PROCESS AND DELIVERY
- As soon as the 50% downpayment is given and acknowledged, I will start with a sketch of your artwork. Please note that sketches may take 5-7 days depending on the workload.- Sketches are subject for approval and revisions. Any pose/ idea revision must be made during the sketch up until the lineart stage. NO FURTHER CHANGES MAY BE MADE TO THE POSE/ IDEA ONCE BASE COLORS HAVE BEEN DONE. Any revisions made to the pose after the base color is done is subject to a 5 USD payment per revision.- Any major edits such as addition or removal of an element in the final piece is subject to an additional charge of at least 5 USD depending on the complexity of the edit.-Revisions of animated commissions: Every animated commission is limited to 3 free movement edits. Any further edits will be subject to additional charges.- Minor color tweaks are free.- All files will be given in PNG format inside a google drive in order to preserve quality.- Each client will get their own google drive folder in which all their past and present commissions will be found.- The client is eligible for the free chibi promo if they order 10+ emotes in one transaction or if they order a total of 10 emotes in a span of 7 days from the initial transaction.- Turnaround time:
--> Sketches: 5-7 days after initial payment
--> Final product: minimum of 14-30 days after approval of sketches up to a maximum of 6 months
--> *Turnaround time varies depending on real life situations and workloadREVISIONS OF OLD COMMISSIONS
- Depending on the complexity of the revision, the client may have to pay a minimum of 5 USD per piece up to the full amount of the entire piece.
- Revisions may be in the form of animating an old emote, redrawing certain parts of the old piece to suit a certain need, and/or changing the color of certain part/s of the piece
REFUNDS
- No refunds are possible after work begins unless initiated by the artist. Exceptions may apply for circumstances such as inability to complete the work or there are delays for unforeseen reasons. In such cases, the client may be eligible for a full refund.- If you cancel your order before I started it, you can get a full refund.
COPYRIGHT/ USAGE POLICY
I, Anissachromia, claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:- Promote myself with it everywhere- Display it everywhere to my liking (website, social media, etc)- Post it wherever I want
The buyer is allowed to:- Use the commissioned piece for personal use unless agreed otherwise- Print the artwork and claim the character as their own, but NOT the artwork itself- Use the artwork to promote themselves. You are not required to give me credit when you post it; however, it is very much appreciated.- Use the artwork on their Youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.
The following is considered copyright infringement:- Reproducing/ using the copyrighted artwork commercially - means making money off it in any way- Claiming the artwork as your own- Removing my signature from the artwork- Altering the artwork without my consent
The client also agrees that they will not use the commissioned piece for training AI data via an automated software process that utilizes artificial intelligence and/or machine learning (such as, but not limited to: DALL-E 2, Crayon, Midjourney, and Stable Diffusion), nor knowingly involve a third-party to act on client’s behalf.I reserve the full rights to the image/s and its use/distribution unless otherwise agreed upon. Rights to the image for your own commercial use may be purchased at any time.If the buyer breaks any of the points stated above, they will lose all the aforementioned rights to the artwork commissioned and I will have the right to profit further from the commissioned artwork in any way I see fit. WHAT DO YOU GET?
- Sketch/es that you must accept before I continue the work- Full resolution PNG file and a smaller version for discord/ twitch emotes inside a google drive- For emote commissions: A compiled version in PNG format- For the free chibi that comes with minimum of 10 emotes: The buyer will get a half chibi of a character of their choice in a pose of their choosing however, edits are limited as this is only FREE and not paid for. If the buyer wishes a full body chibi, additional payment must be made to upgrade this free chibi. The client may also opt not to claim this or may opt to upgrade to a different service (ie. headshot, half body, etc) provided that they will pay for the rest of the service cost.- For the compiled version of the emotes (for 10+ orders): The artist will be the one to decide on the background of the compilation however the buyer may give a color scheme or a theme of their choosing. The final product will still be the artist's discretion.- For the compiled version of the emotes (<10 emotes): The default compilation template will be used by the artist.
